Arbitration

 

Arbitration is a widely accepted and established mode of commercial dispute resolution locally and abroad. The Arbitration Act 42 of 1965 was enacted to provide for the settlement of disputes through arbitration and for the enforcement of arbitration awards and it is supported by the courts, notably in the apex Constitutional Court decision Lufuno Mphaphuli & Associates (Pty) Ltd v Andrews and Another 2009 (4) SA 529 (CC).
Many Group One senior members are regularly appointed as arbitrators to preside in arbitration tribunals of first instance and in appellate arbitration tribunals. Most of our members are also regularly briefed appear as counsel in arbitrations and are familiar with the rules and procedures for arbitration including the domestic AFSA rules and the international UNICITRAL rules.

Many of our members are certified affiliates of and serve on the Panel of Arbitrators of the Arbitration Foundation of Southern Africa (AFSA), a private dispute resolution authority which manages the resolution of a wide range of local and international disputes through arbitration and other alternative dispute resolution processes.
